Scope and object of the bed and breakfast service (B&B)
1.1. These General Terms and Conditions of Service bb regulate the relationship between the Bed and breakfast Attico 195 (hereinafter ‘B&B’) and the Client with regard to the provision of accommodation Services chosen by the Client in the booking made online among those offered by the B&B, viewable on the website www.attico195salerno.it.
1.2. The request for the provision of the Services may be made by the Client by submitting the Booking Proposal to the B&B by means of: online booking on the website, sending an email via the contact form on the website, by telephone, verbally.
1.3. The contract is deemed to be concluded when the Customer makes the Booking Proposal in the manner stipulated under 1.2. and brings it to the attention of the B&B. The actual conclusion is always subject to the availability of the Service. This confirmation is provided by the B&B upon receipt of the Proposal or immediately thereafter by e-mail or telephone.
1.4. If the activation of the Services cannot take place due to impediments not attributable to the B&B, the contract shall be automatically terminated, without any liability of the B&B towards the Customer.
Activation and provision of the Service.
2.1. Upon activation of the Service, the B&B guarantees the Customer
- the enjoyment of furnished accommodation units (hereinafter ‘Rooms’), in the number and type defined in the Proposal.
– breakfast, if included in the rate, will be served at a partner café communicated at the beginning of the stay.
2.2. the B&B shall give the Client any other accessory equipment on loan for the complete use of the chosen Services (accommodation keys, etc.).
2.3. The Client shall use the rooms, common areas and equipment in such a way as not to disturb the normal course of the Service and third parties accommodated in the B&B facilities. The Customer shall be exclusively liable for any direct damages, which may arise from the breach of this obligation, and shall indemnify the B&B against any consequences, costs or charges.
2.4. The Customer shall indemnify the B&B from any prejudice, damage, liability, expenses, including legal expenses, suffered or incurred by the B&B, and shall also indemnify the B&B from any action, reason, claim made by third parties against the B&B that are caused or motivated by behaviour and/or omissions in any way attributable to the Customer or are in any case a consequence of the non-compliance and/or breach of the precepts set out in these General Terms and Conditions of the B&B Service.
Reservation payment methods.
3.1. In the case of online, email or telephone reservations, the following payment methods may be used:
- IBAN transfer, the details of which are provided at the time of reservation
- cash on the spot
- credit card, including PayPal.
To confirm your reservation for standard rates, with and without breakfast, you must pay a deposit equal to 30% of the cost of your entire stay by bank transfer or credit card charge or PayPal.
The payment details will be communicated at the time of the room reservation request.
The balance will be paid at the beginning of the stay.
In order to confirm the booking for the non-refundable rate it is necessary to pay the full amount of the stay by bank transfer or credit card debit or PayPal.
Contract duration, cancellations and penalties.
4.1. The Contract shall be valid and effective from the date of conclusion of the Contract and shall end if both of the following conditions are met
- the Customer and third parties connected to or employed by the Customer have left the B&B Accommodation permanently
- the Client has paid the full amount due to the B&B.
4.2. Check-in must take place between 15:00 and 20:00 and there is no possibility of using the entire facility before this time. Any arrivals outside these hours must be agreed in advance with the B&B at an additional cost of €10.00. Failure to give prior notice may result in long waits for which no claims or refunds will be accepted. Check-out must strictly take place in winter by 10.00 a.m., if this does not happen the cost of an additional night will be charged.
4.3. the customer is entitled to cancel the booking and terminate the contract. In this case he is entitled to a refund if paid in advance. This fee is a function of the time in advance (with respect to the planned check-in date) with which the customer informs the B&B of the cancellation.
Below are the refund fees according to the type of rate:
Standard rate with or without breakfast:
- 100% refund if the cancellation arrives by the fifth (5th) day prior to the stay,
- In case of cancellation from the fifth day prior to the stay until the day before the stay, the deposit of 30% of the stay is retained.
- In case of no-show (no show) the customer will be required to pay the entire booked stay.
Standard rate with or without breakfast:
- 100% refund if the cancellation arrives by the fifth (5th) day prior to the stay,
- In case of cancellation from the fifth day prior to the stay until the day before the stay, the deposit of 30% of the stay is retained.
- In case of no-show (no show) the customer will be required to pay the entire booked stay.
Standard rate Not Refundable:
The customer will be required to pay the entire stay booked.
limits of liability
8.1. The B&B will not be liable in the event of delays, inconveniences, malfunctions and/or interruptions of the Service due to
- unforeseeable circumstances or force majeure
- tampering or interventions on the Service or equipment carried out by the Customer or by third parties not authorised by the B&B.
- damage or inconvenience caused by the total or partial interruption of the electricity or water supply.
- The B&B shall not be liable for valuables not deposited in the B&B safes. In any case, the B&B will not be held responsible for any theft of objects and valuables deposited in the safes of each room as it would not be possible to prove and quantify the actual contents.
The B&B staff recommends:
9.1. Silence/Children. Total silence must be observed from 23:00 to 08:00 and from 14:00 to 16:00;
Children must always be accompanied by an adult person. In any case, behaviour must be maintained that at no time of the day and in no way impairs the peace and quiet of others;
9.2. Cleaning. Rooms are cleaned daily. Rooms must be vacated by 10 a.m. for cleaning. If the rooms are not vacated by 10.30 a.m., cleaning will be postponed until the following day unless agreed with the owner. You are kindly requested to arrange your personal belongings in such a way as to allow for such cleaning.
No reimbursement is provided for guests who leave the B&B early, whatever the cause.
Protection of privacy.
5.1. The Customer is informed, in accordance with Article 13 of Legislative Decree no. 196/2003, that the processing of personal data provided to the B&B is necessary in order to allow the B&B directly or through third parties to fulfil the obligations arising from this contract or for the fulfilment of obligations under the law or regulations.
5.2. The data controller is the owner of the B&B.
Documents.
6.1. Upon arrival at the B&B and, if in online procedure before arrival, valid identity documents (Passport, Identity Card, other valid document) necessary for the registration required by law must be handed over. Failure to comply with this obligation constitutes a violation of the rules of the penal code and entitles us to demand the immediate abandonment of the B&B. The data of our guests are treated in accordance with current privacy regulations.
Liability of the B&B.
7.1. The B&B will be liable for the non-performance of the contract and the provision of the Service solely for reasons attributable to it.
7.2. If the Customer on arrival notices a different Service from the agreed one but accepts it anyway, he/she will be automatically forfeited from any claim for compensation and the new Service replaces, by agreement of the parties, the previously agreed one.
9.3. Other Guests It is strictly forbidden to bring other people into the room, the terrace and any other area of the B&B without the manager's authorisation, under penalty of a € 250.00 surcharge. The customer may not sublet or loan the room, in whole or in part, under penalty of cancellation of the booking right and a € 250.00 surcharge.
9.4 Breakfast. Breakfast is served at participating bars, cafés or pastry shops communicated by the owner or his deputy at the time of check-in. Any vegan/vegetarian/ciliac breakfasts must be communicated prior to the start of the stay.
9.5. Smoking/Guns/Drugs It is strictly forbidden to introduce, weapons, drugs and other substances. On pain of immediate termination of contract. Smoking in the room is also strictly forbidden. You may smoke freely on the terrace, strictly using the ashtrays provided there.
9.6. Personal Objects You may not leave objects of any kind in the corridors or common areas . The B&B is not responsible for personal objects left unattended. The B&B is not responsible for lost, stolen or damaged objects left in the rooms unattended.
9.7. Animals. It is strictly forbidden to introduce animals of any kind or size;
9.8. Toilets. We recommend a correct and civilised use of the toilets, avoiding throwing anything in the toilet (use the appropriate bins).
